A cannabis farm’s neighbor can sue them for scents and different aggravations that could hurt their property values, a government appeals court ruled Wednesday.
The tenth U.S. Circuit Court of Appeals decision restores a claim between a Colorado horse cultivate and a neighboring maryjane developing stockroom.
The horse farm’s owners, the Reillys, sued in 2015, guaranteeing that the distribution center would reduce their property's estimation by radiating "harmful scents" and pulling in obnoxious guests. A federal district court rejected the Reillys' case, and the stockroom opened in 2016.
